Anesthesia Malpractice Case Verdict in Illinois

On Thursday in La Salle County Circuit Court, a jury decided Adam Porter should receive nearly $24 million from a doctor and nurse practitioner in a malpractice case.

The 34-year-old Streator man filed a lawsuit in May 2003 against Ephraim W. Batambuze, M.D., John E. Podzamsky, D.O., registered nurse anesthetist Linda Blair of A.T. Associates and nurse practitioner Patricia Duffield, as well as against Batambuze's practice, Prairie Cardiovascular Consultants.

Porter said he entered St. Mary's Hospital in Streator in November 2001 for surgery involving a kidneystone in his ureter. During surgery, he underwent cardiac arrest and the flow of oxygen to his brain was interrupted.

hello I have a question regarding medical malpractice with the use of anesthesia...I intially went under surgery for a spinal c-6 neck fushion..As a result of the surgery I developed mrsa wich is a antiobiotic resistant infection..Because of this infection I had to go back under the knife for them to cut out the infection...During the surgery I woke up and sat up without realizing were I was and I pulled the breathing tub out of my mouth then I felt and incredible pain the brought me to complete awareness...The surgical team slammed me back down on the table and I started screaming wait wait am I sappose to b awake right now the doctor told me no but that he was almost finished all he had to do was put the drainage tube in my neck were the incision was and that he was done...I began demanding that they put me back under and they refused stating that I would b under for another 30 min and that what he had to do would only take a few minutes so he began pushing the tube into my neck..It was the worst pain I ever felt and I was screaming in agony and pleading for them to please stop and put me back under all the while the surgical team was holding my arms down because I was going to hit the doctor for inflicting so much pain on me...I in my life never felt so much fear and pain...As a result I have had to be under phchyatric care and have been diagnosed with post tramatic stress disorder extreme anxiety disorder and depression...I relive this everyday of my life I have nightmares and I cant even go out of my home with have panic attacs..DO U FEEL THAT I HAVE A MALPRACTICE SUIT IN THIS SITUATION???ALSO THE INFECTION THAT THEY GAVE ME THE MRSA IS SOMETHING THAT I HAVE TO LIVE WITH THE REST OF MY LIFE AND IT CAN COME BACK AT ANY TIME IN MY LIFE AND THERE IS A GOOD CHANCE THAT IT CAN KILL ME...IT HAD BEEN DEAMED A LIFE TIME ENVIRONMENTAL DISABILLATY AND IT KILLED 15000 PEOPLE LAST YR ALONE...WHAT SHOULD I DO????

I would say that this is a difficult case to prove. In many medical incidents, there is such a thing a risk of the procedure. So it is possible that this is one of those. I'm not saying what happened to you is OK, I'm saying that sometimes bad results are not always malpractice.

We may need to know more about what happened to you and what exactly happened to cause you to awake to tell if there is a case.
